To use GrowGen, you must:

We reserve the right to suspend or terminate accounts that provide false information.

You may be required to create an account to access certain features. You agree to:

• Maintain the confidentiality of your login credentials
• Accept responsibility for all activity occurring under your account
• Notify us immediately of unauthorized access or security concerns

GrowGen is not responsible for losses resulting from unauthorized use of your account.

Certain features of GrowGen may require a paid subscription. By purchasing a subscription, you agree that:

• Fees are charged according to the selected plan
• Subscription fees may be billed monthly or annually
• Subscription payments automatically renew unless canceled before the renewal date
• Pricing may change with prior notice

Failure to process payment may result in suspension or loss of access to Services.

Unless otherwise required by law:

• Subscription fees are non-refundable
• Partial billing periods will not be prorated
• Promotional offers or discounts may be subject to separate terms

We reserve the right to provide refunds at our sole discretion.

• Upload harmful, fraudulent, or misleading content
• Attempt to gain unauthorized access to systems or data

• Use GrowGen to generate spam, deceptive marketing, or malicious content
• Violate intellectual property rights

We reserve the right to remove content or suspend accounts that violate these Terms.

You retain ownership of content you submit to GrowGen, including prompts, text, images, and uploaded materials ("User Content").

By submitting content, you grant GrowGen a non-exclusive, worldwide, royalty-free license to process, store, display, modify, and analyze your content solely for the purpose of providing and improving the Services.

You represent that you own or have the rights necessary to submit such content.

GrowGen uses artificial intelligence to generate content, recommendations, insights, and other outputs. You acknowledge and agree that:

• AI-generated content may contain inaccuracies, errors, or outdated information
• Results may vary and are not guaranteed
• AI-generated content should not be considered legal, medical, tax, financial, or professional advice
• Users are solely responsible for reviewing, editing, and validating generated content before use

GrowGen does not guarantee the accuracy, reliability, or suitability of AI-generated outputs.

GrowGen and all related materials, including logos, branding, software, features, text, graphics, design elements, and content templates, are owned by GrowGen and protected by applicable intellectual property laws.

Except as expressly permitted, users may not reproduce, distribute, modify, resell, or create derivative works from GrowGen materials without written permission.

GrowGen may integrate with or provide access to third-party services, including:

• Payment processors
• Analytics providers
• AI providers
• Social media platforms
• Email services

GrowGen is not responsible for third-party services, content, or privacy practices. Use of third-party services is subject to their own terms and policies.

We strive to provide reliable Services but do not guarantee uninterrupted access. GrowGen may modify features, suspend services, remove functionality, perform maintenance, or update the platform without prior notice.

We reserve the right to suspend or terminate your access at any time if:

• You violate these Terms
• You engage in unlawful or harmful activity
• Continued use creates risk to GrowGen or its users

Upon termination, your right to use GrowGen ends immediately. Certain provisions of these Terms may survive termination.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, GROWGEN DISCLAIMS ALL WARRANTIES, INCLUDING merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and availability.

We do not guarantee that Services will be uninterrupted, secure, or error-free.

To the maximum extent permitted by law, GrowGen and its owners, employees, affiliates, and partners shall not be liable for:

• Indirect damages
• Consequential damages
• Lost profits
• Lost business opportunities
• Data loss
• Service interruption
• Damages arising from reliance on AI-generated content

GrowGen's total liability shall not exceed the amount paid by you for the Services during the preceding twelve (12) months.

You agree to defend, indemnify, and hold harmless GrowGen and its affiliates from claims, damages, liabilities, expenses, and costs arising from:

• Your use of the Services
• Your content
• Violations of these Terms
• Violations of laws or third-party rights

We reserve the right to remove allegedly infringing content and terminate repeat infringers.

Users are responsible for all content submitted, uploaded, generated, or shared through GrowGen. We reserve the right, but are not obligated, to review, remove, restrict, or disable content that we reasonably believe:

• Violates these Terms
• Is illegal or fraudulent
• Is harmful, threatening, abusive, or defamatory
• Contains hate speech or discriminatory content
• Violates intellectual property rights
• Promotes spam or malicious activity
• Creates risk to GrowGen or other users

GrowGen may suspend or terminate accounts associated with repeated violations. We are not responsible for user-submitted content or opinions expressed by users.

GrowGen may occasionally recommend products, services, software tools, or resources from third-party providers. Some recommendations may include affiliate links, meaning GrowGen may receive compensation if users purchase through those links. This compensation:

• Does not increase the price paid by users
• Helps support GrowGen operations and development
• Does not influence our commitment to providing honest recommendations

Users should independently evaluate products and services before purchasing.

If you access GrowGen through a mobile application downloaded from an app marketplace such as Apple's App Store or Google Play, additional terms may apply. You acknowledge that:

• These Terms are between you and GrowGen only, not Apple or Google
• Apple and Google are not responsible for the Services
• App stores have no obligation to provide maintenance or support
• App stores are not responsible for claims relating to GrowGen
• Your use of the app must comply with applicable marketplace terms

Apple and its subsidiaries may be considered third-party beneficiaries of these Terms where required.

GrowGen may offer free trial periods for certain subscription plans. By enrolling in a free trial, you understand that:

• Payment information may be required at signup
• Unless canceled before the trial period ends, the subscription may automatically convert into a paid plan
• Charges will occur according to the selected subscription terms
• Users are responsible for canceling before the renewal date if they do not wish to continue

GrowGen reserves the right to modify, suspend, or terminate free trial offers at any time.

GrowGen may use third-party payment processors, including Stripe, to process subscription fees and payments securely. By providing payment information, you:

• Authorize GrowGen and its payment processors to charge your selected payment method
• Agree to the applicable terms and policies of the payment processor
• Understand that payment information may be collected and processed directly by the payment processor

GrowGen does not store complete payment card information on its own servers. GrowGen is not responsible for payment processing errors or interruptions caused by third-party payment providers.
